Welcome to E-Raiden. These Terms of Service ("Terms") are the contract between you and GiBSeS OÜ, a company registered in Estonia (VAT number EE103040763, Harju maakond, Tallinn, Kesklinna linnaosa, Juhkentali tn 8, 10132, Estonia; "E-Raiden", "we", "us"). They govern your use of the E-Raiden website, the mobile apps and every related service (together, the "Service"). We have tried to write them in plain language. Nothing in these Terms limits the rights that mandatory consumer law of your country gives you.
1. Acceptance of the Terms
You accept these Terms when you create an account, by ticking the acceptance box at sign-up. If you do not accept them, please do not use the Service.
The Service has two tiers. The free tier includes every dating feature and is funded by advertising: ads are personalised only if you consent to it, otherwise they are contextual, as explained in the Privacy Policy. Premium is an optional paid subscription, described in section 4.
2. Age Requirements
The Service is reserved exclusively for persons who are at least 18 years old. By registering, the user represents and warrants that they are at least 18. Age is self-declared at registration (and enforced by the platform); E-Raiden does not perform paid identity verification but reserves the right to suspend or delete accounts that appear to belong to minors.
In the event of a breach of this requirement, the account will be deleted immediately and without notice. Any associated data will be deleted in accordance with our Privacy Policy.
3. User Account
To use the features of the Service, you must create an account by providing truthful, accurate and complete information. The user is responsible for:
- Maintaining the confidentiality of their access credentials
- All activities that occur on their account
- Updating profile information promptly
- Notifying E-Raiden immediately in case of unauthorized access
Each person may hold only one account, which is personal and cannot be transferred, sold or lent. Suspension and closure of accounts, including inactive ones, are governed by section 9.
4. Premium Subscription
E-Raiden is free, includes every dating feature and is funded by advertising. You can optionally subscribe to Premium, which gives you two things: no advertising and priority access when the Service is overloaded (see section 5). Premium unlocks no additional dating feature: profiles, matches, chat, Radar and every other function are available to all users in the same way.
Premium costs €7.99 per year and renews automatically for successive twelve-month periods until you cancel. Payments are processed by Stripe. You can cancel the renewal at any time from Settings › Privacy, Premium section, using “Cancel renewal”: cancelling gives no right to a refund, Premium stays active until the end of the period you have already paid for, and from then on your account returns to the free, ad-supported tier.
Purchases in the apps. In the Android and iOS apps, Premium is sold through Google Play or the Apple App Store, at the price shown in the store. Those purchases are also governed by the terms of the store, which handles payment, renewal, cancellation and refunds; your statutory rights towards us are not affected. Countries where Premium is not sold on the web. For tax reasons Premium cannot be bought on the website from some countries: if this applies to you, the purchase page tells you, and you can activate Premium in the app.
If you buy Premium as a consumer, you have the right to withdraw from the contract within 14 days of concluding it, without giving any reason and without penalty (Articles 9 to 16 of Directive 2011/83/EU). The period runs from the day Premium is activated, that is from your first purchase; automatic renewals continue the same contract and do not open a new period. You exercise withdrawal from Settings › Privacy, section “Right of withdrawal (14 days)”, using “Exercise the right of withdrawal”; while the period is open, that page shows you the date by which you can do so. You may also notify us of your withdrawal by sending an explicit statement to office@e-raiden.vip. Withdrawal closes Premium at once — advertising returns to your account — and we credit the refund using the same means of payment you used for the purchase, within 14 days of receiving your notice.
The amount of the refund depends on one circumstance only: whether, at the time of purchase, you expressly requested that Premium start immediately, without waiting for the 14 days to end. If you requested the immediate start — by ticking the dedicated box on the purchase screen, which is neither pre-ticked nor mandatory — we retain the share proportionate to the period you have already enjoyed, that is the annual price divided by 365 and multiplied by the whole days elapsed since activation, and we refund you all the rest (Article 14(3) of the Directive). If you did not request the immediate start, the refund is for the full amount: we charge you nothing for the days of use (Article 14(4)(b)). In no case does withdrawal entail any cost or penalty for you.
Withdrawal and cancellation are different things, and in the app they are two distinct commands. Withdrawal is available only within 14 days of purchase: it closes Premium at once and entitles you to the refund described above. Cancelling the renewal is available at any time, including after the 14 days: it gives no right to a refund, Premium stays active until the end of the period you have already paid for, and simply does not renew. In short: if you are within the 14 days and want your money back, you need withdrawal; if you only want to stop paying for the following year, you need cancellation.
Price changes. We may change the Premium price for objective reasons, such as changes in our costs, in taxes or in market conditions. We tell you by email at least 30 days before the renewal at which the new price applies; the new price never applies to the period you have already paid for, and you can cancel the renewal at no cost before it takes effect. For purchases in an app store, the store sets and communicates the price.
Free trials and promotional codes. A free Premium trial or a promotional code is personal, cannot be transferred or resold, has no cash value and cannot be exchanged for money. The conditions shown when you activate it apply (duration, who can use it, one per person). A free trial does not turn into a paid subscription and does not require a card. If a trial or code was obtained by abuse — for example with several accounts, or a code that was resold — we may cancel it, telling you the reason.
Disputed payments (chargebacks). If you dispute a Premium payment with your bank or card issuer, we may suspend Premium while the dispute is open, and keep it suspended if the dispute turns out to be unfounded until the amount is settled. Your free account is not closed for this reason alone. This does not limit your right to dispute a payment you did not authorise.
5. Availability, Capacity and Fair Use
5.1 Availability and maintenance
We work to keep the Service available and secure, but we cannot promise that it will always work without interruptions or errors. The free tier is offered without a guaranteed level of availability. This does not affect your statutory rights: the Service must still match these Terms and what you can reasonably expect, and if it does not you keep the remedies that consumer law gives you.
We may interrupt the Service for maintenance and updates. Where possible we do it at times of low traffic and announce planned interruptions in advance in the app; urgent interventions, for example to fix a security problem, may happen without notice.
5.2 Peaks of traffic: waiting room and priority access
If too many people use the Service at the same time, we may temporarily limit access to keep it stable for everyone:
- new access by free-tier users may be placed in a waiting room (queue): you get in as soon as there is room;
- people already using the Service are not disconnected to make room for others;
- Premium users have priority access while the overload lasts;
- within each tier everyone is treated in the same way, in order of arrival;
- we may also temporarily slow down or pause the most demanding functions — for example automatic translation of messages or how often Radar refreshes — and restore them as soon as traffic returns to normal.
These are temporary measures and last only as long as the overload. We do not create queues or slowdowns artificially.
5.3 Fair use
To protect the Service and its users we apply technical limits, for example on the number of likes, messages, photo uploads, translations or requests in a given time. The limits are designed to cover normal personal use and apply equally to every user, free or Premium. If you reach a limit, the function becomes available again after the time shown in the app.
5.4 Automatic translation and location
Automatic translation of messages is done by software, without human review: it may be inaccurate or miss nuances, so check anything important with the other person before relying on it. Distances and positions shown in the Service, including in Radar, are approximate and deliberately rounded to protect privacy: they never show anyone's exact position and must not be used to locate a person.
6. User Conduct
By using the Service, the user agrees NOT to:
- Create fake profiles or use the identity of others
- Harass, intimidate, threaten or defame other users
- Send unsolicited commercial messages (spam)
- Post illegal, offensive, obscene or discriminatory content
- Solicit money or financial information from other users
- Use the Service for illegal activities of any kind
- Attempt to access other users' accounts or data
- Use bots, scrapers or other automated tools
- Circumvent the security measures or restrictions of the Service
- Create more than one account, or a new account, to get around a limit, the waiting room, a promotion or a suspension
- Overload the Service on purpose or interfere with its normal operation
If you break these rules we take the measures described in section 9, in proportion to the seriousness of the breach, and in the most serious cases we report the matter to the competent authorities.
7. User Content
You keep ownership of the content you post (photos, texts, messages) and you are responsible for it: you confirm that you have the right to post it. To run the Service you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for example resize a photo or translate a message) and display that content, only to provide, secure and improve the Service. Our service providers may use it on our behalf for the same purposes only. The licence ends when you delete the content or your account, except for copies we must keep by law and for the limited backup periods described in the Privacy Policy.
It is forbidden to post:
- Sexually explicit or pornographic content
- Images depicting minors
- Violent, racist or hate-inciting content
- Personal information of third parties without their consent
- Copyright-protected material for which the user does not hold the rights
We moderate content with automated tools and with human review. If content is illegal or breaches these Terms we may remove it or limit its visibility; when we do, we send you a statement of reasons and you can challenge the decision (section 9). Anyone can report content they believe to be illegal with the tools in every profile and conversation or through the report form.
Keep your own copies. E-Raiden is not a storage service: keep your own copy of anything that matters to you. You can download your data at any time from Settings › Privacy ("Export my data").
8. Meeting People and Safety
E-Raiden helps people get in touch. We do not promise that you will find matches, receive replies or meet someone, nor that the people you meet will be right for you.
We do not carry out criminal background checks or identity verification of our users, unless a feature expressly says otherwise. Profiles are written by users and may contain inaccurate information. Be careful before sharing personal information, sending money or meeting someone.
Meeting someone in person is your choice and your responsibility. Meet in a public place, tell someone you trust, arrange your own transport and never send money to people you have not met. Read our Safety Center before you meet anyone. In an emergency, contact the local emergency services first (112 in the European Union).
Each user is responsible for their own content and behaviour, online and offline. We are not responsible for the conduct of other users, but we act on it: every profile and conversation has tools to report and block, we examine reports carefully and without undue delay, and we remove illegal content as soon as we become aware of it, as required by the Digital Services Act.
9. Suspension, Closure and Inactive Accounts
9.1 Closing your account
You can close your account at any time, free of charge, from Settings › Account or from this page. If you have Premium, section 4 explains withdrawal and cancellation.
9.2 Measures we may take
We may remove content, limit some features, temporarily suspend an account or, in the most serious cases, close it, when:
- you breach these Terms or the law;
- it is necessary to protect the security of the Service or of other people, for example if an account has been compromised;
- a court or a competent authority orders us to;
- there is fraud or payment abuse (for disputed payments, see section 4);
- the account belongs to a person under 18 (section 2).
We choose the least severe measure that is adequate — for example limiting a function before suspending, and suspending before closing — taking into account how serious and how frequent the breach is and whether it was intentional. Where possible the measure is temporary.
Every time we take one of these measures we send you a statement of reasons: what we decided, why, which clause or law is concerned and whether automated means were used (Article 17 of the Digital Services Act). You find it in Settings › Moderation. You can submit a free internal complaint within six months: it is examined under human supervision and, if it is upheld, we reverse the measure without undue delay (Article 20 DSA). You can also refer the dispute to a certified out-of-court dispute settlement body (Article 21 DSA) or to a court.
If we close your account or end Premium without fault on your part, we refund the share of the Premium price paid on the web for the period not yet used.
9.3 Inactive accounts
If you do not log in for 12 months, we may deactivate your account: your profile is hidden from other users and your data are kept. We will email you at least 30 days in advance, and logging in during that time is enough to keep the account active. You can reactivate a deactivated account simply by logging in. If it stays deactivated for a further 12 months, we delete it, after another email notice at least 30 days in advance. Accounts with an active Premium subscription are not deactivated for inactivity.
10. Intellectual Property
The Service and all of its original content (excluding user content), features, graphics, design and source code are and remain the exclusive property of E-Raiden and its licensors. The Service is protected by copyright, trademark and other intellectual property laws.
The "E-Raiden" trademark, the logo and all related marks are trademarks of GiBSeS OÜ. Use of these marks is not permitted without the prior written consent of the owner.
11. Liability
Nothing in these Terms excludes or limits our liability: for death or personal injury; for damage caused intentionally or through gross negligence; for the lack of conformity of the Service where you are a consumer; or in any other case in which mandatory law does not allow it.
Apart from those cases, if we cause damage through slight negligence we are liable only when we breach an essential obligation of the contract (one that makes the Service possible and on which you may reasonably rely), and only for the damage that was typical and foreseeable when you accepted these Terms. For the free tier, which has no monetary price, our total liability for slight negligence is limited to €100; for Premium, to the higher of €100 and the amount you paid us in the 12 months before the event.
We are not responsible for the content and behaviour of other users, online or offline (section 8), nor for third-party websites and services you choose to use outside the Service, such as the pages advertisers link to.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, such as natural disasters, war, epidemics, widespread internet or power outages, failures of infrastructure providers, attacks we could not reasonably prevent or measures of public authorities. We will inform you and restore the Service as soon as reasonably possible. Your rights as a consumer if the Service is not in conformity are not affected.
12. Changes to the Service and to the Terms
12.1 Changes to the Service
The Service evolves. We may add features or make changes that improve the Service or that do not affect you negatively at any time. We may change, reduce or remove features, or change the conditions of the free tier, only for one of these reasons:
- to comply with the law, with regulations or with a decision of a court or authority;
- to protect security or the integrity of the Service and of its users;
- for reasons of capacity, or because the costs are no longer covered by advertising and Premium income;
- for technical evolution, for example new versions, or the end of support for a technology, a provider or an operating system;
- to prevent abuse or fraud.
Where possible we prefer a temporary limitation to the permanent removal of a function.
12.2 Notice and your right to terminate
If a change to the Service or to these Terms affects you negatively in a way that is more than minor, we tell you by email and in the app at least 30 days before it takes effect, explaining what changes and why. You can then terminate the contract free of charge, by closing your account, within 30 days of the notice or of the change, whichever is later; if you have Premium bought on the web, we refund the share of the price for the remaining period (Article 19 of Directive (EU) 2019/770). Changes required by law or urgently needed for security may take effect sooner: in that case we inform you as soon as possible.
12.3 Suspension of the free tier
If the free tier can no longer be sustained — because its costs are not covered by advertising and Premium income, for reasons of capacity, or for legal, regulatory or technical reasons — we may suspend it, everywhere or in some countries, and keep only Premium. In that case:
- we tell you by email and in the app at least 60 days in advance, explaining the reason;
- from the date of suspension, free accounts are deactivated, not closed: your profile is hidden from other users, your data are kept, and you can only subscribe to Premium, download your data or delete your account;
- your account is reactivated automatically, with its data, when the free tier resumes or if you subscribe to Premium;
- you are never charged without an explicit purchase of your own;
- existing Premium subscriptions continue unchanged on their own terms;
- if the free tier has not resumed within 12 months of the suspension, deactivated accounts are deleted, after a further email notice at least 30 days in advance;
- you can always download your data from Settings › Privacy ("Export my data") and delete your account free of charge.
12.4 Changes to the Terms
We update these Terms only for the reasons listed in section 12.1, to reflect changes in the Service, or to make them clearer. The date of the current version is shown at the top of this page. For changes to your detriment that are more than minor we give you the notice described in section 12.2, reminding you that the new Terms apply from the date indicated and that you can close your account free of charge before then. Where the law requires your consent to a change, we will ask for it.
13. General Provisions
Third-party services. To provide the Service we rely on third parties, such as Stripe for web payments, Google and Apple for the app stores, payments and notifications, and hosting and infrastructure providers. When you use their services directly — for example when you buy in an app store — their terms also apply. Towards you, we remain responsible for the Service as a whole, within the limits of section 11.
Transfer of the contract. We may transfer this contract to a company that takes over the Service, for example after a merger or the sale of the business, provided your rights under these Terms are not reduced. We will tell you by email in advance; if you do not agree, you can close your account free of charge. You may not transfer your account or this contract.
Communications. We send you communications about the contract by email to the address of your account and in the app: keep your email address up to date. You can write to us at office@e-raiden.vip or by post to the address shown at the beginning of these Terms.
Invalid clauses. If a clause of these Terms is found to be invalid, the other clauses remain in force, and the invalid clause is replaced by the applicable provisions of law.
Entire agreement. These Terms, together with the Privacy Policy, the Cookie Policy and the specific conditions shown when you buy Premium or activate a promotion, form the whole agreement between you and us about the Service. The information we are required by law to give you before the contract, and your statutory rights, also form part of it.
No waiver. If we do not enforce a clause straight away, we do not give up the right to enforce it later.
Languages. These Terms are available in several languages and you can rely on the version in your language. If the versions differ, the English version is the reference text; if you are a consumer, any doubt about the meaning of a clause is resolved in the way most favourable to you.
14. Governing Law and Disputes
These Terms are governed by the law of the Republic of Estonia, where GiBSeS OÜ has its registered office. If you are a consumer, this choice does not deprive you of the protection of the mandatory provisions of the law of the country where you habitually reside (Article 6(2) of Regulation (EC) No 593/2008, "Rome I"). As a consumer you may bring proceedings in the courts of your country of residence, and we may bring proceedings against you only there. For users who are not consumers, the courts of Tallinn (Estonia) have jurisdiction.
Consumers residing in the European Union retain every right granted to them by EU consumer law. For an out-of-court settlement of a dispute you may turn to the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon) at the Estonian Consumer Protection and Technical Regulatory Authority (TTJA), or to the European Consumer Centre in your country, which assists free of charge with cross-border disputes within the EU. Your right to bring the matter before the competent court is unaffected.
15. Additional terms for United States users
This section applies if you live in the United States. It forms part of these Terms; if it conflicts with another section, this section prevails for US users. Sections 11 (Liability) and 14 (Governing Law and Disputes) do not apply to US users to the extent they are inconsistent with this section.
15.1 Binding individual arbitration
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU AND GIBSES OÜ TO RESOLVE DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION INSTEAD OF IN COURT, AND IT WAIVES THE RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS ACTION. YOU CAN OPT OUT WITHIN 30 DAYS (SEE BELOW).
- Informal resolution first: before starting arbitration, the party with a claim must send the other a written notice describing the dispute and the relief sought (to us: by email to the contact at the end of these Terms). Both parties will try in good faith to resolve it within 60 days. Limitation periods are paused during this time.
- Agreement to arbitrate: any dispute, claim or controversy between you and GiBSeS OÜ arising out of or relating to these Terms or the service, including its formation, scope and validity, will be resolved by binding individual arbitration, except as stated below.
- Rules and forum: the arbitration is administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org, before a single arbitrator. It takes place by video conference or written submissions, or in person in the county where you live if you prefer. We will pay the AAA filing, administration and arbitrator fees beyond the amount you would pay to file a claim in court, unless the arbitrator finds your claim frivolous.
- Small claims: either party may instead bring an individual claim in small claims court, if the claim qualifies and stays there on an individual basis.
- Class action and jury trial waiver: you and GiBSeS OÜ may bring claims against each other only in an individual capacity, not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims of more than one person. YOU AND GIBSES OÜ WAIVE THE RIGHT TO A JURY TRIAL.
- Mass arbitration: if 25 or more similar demands are filed against us by or with the help of the same or coordinated counsel, they will be administered in batches of up to 25 demands (one batch at a time, each with one arbitrator), under the AAA Mass Arbitration Supplementary Rules where applicable. Limitation periods are paused for demands waiting in a later batch.
- 30-day opt-out: you can opt out of this arbitration agreement by sending, within 30 days after you first accept these Terms, an email to the contact at the end of these Terms with the subject "Arbitration opt-out", your name and the email address of your account. Opting out does not affect any other part of these Terms.
- Severability: if the class action waiver is found unenforceable for a claim, that claim (and only that claim) will be decided in court, not in arbitration. Any claim for public injunctive relief will be severed and decided by a court, after the individual claims have been arbitrated. If any other part of this section is found unenforceable, the rest remains in force.
15.2 Governing law and courts
This arbitration agreement is governed by the Federal Arbitration Act. Otherwise, for US users these Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. This choice does not deprive you of the protection of the mandatory consumer protection laws of your state of residence. Any claim not subject to arbitration will be brought in the state or federal courts located in Delaware, unless the law of your state gives you the right to bring it in the courts where you live.
15.3 Copyright (DMCA)
We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act and terminate, in appropriate circumstances, the accounts of repeat infringers. See our Copyright and DMCA Policy.
15.4 No background checks
E-Raiden does not conduct criminal background checks or identity verification on its members.
Always use caution when interacting with people you meet through the service. Read our Safety Center before meeting anyone in person.
15.5 Paid subscriptions and automatic renewal
- If you purchase a paid subscription, before you pay we show you clearly the price, the billing period, that the subscription renews automatically at the end of each period until you cancel, and how to cancel. We ask for your express consent to these terms and send you an email confirmation with the same information and the cancellation instructions.
- Cancel online at any time: on the website, from Settings › Privacy, Premium section, using "Cancel renewal"; if you bought through Google Play or the Apple App Store, from the subscription settings of that store. Cancellation takes effect at the end of the current period, and you keep Premium until then.
- Reminders: for subscriptions with a term of one year or longer, and before a free trial converts into a paid subscription, we send you a reminder before you are charged, within the time required by your state's law, with the price and how to cancel.
- Price changes: we will notify you of any price change before it applies to your next renewal, and you can cancel before it takes effect.
15.6 Dating service cancellation rights
If you purchase a paid subscription and live in a state whose dating-service laws apply to it (for example California, Civil Code §1694 et seq., and New York, General Business Law §394-c), you also have the following rights:
- Three business days to cancel: you may cancel the subscription, without any penalty or obligation, at any time before midnight of the third business day after the date of purchase (excluding Sundays and holidays), and receive a full refund. To cancel, send a signed and dated notice, or an email, to the contact at the end of these Terms stating that you cancel. We refund you within 10 days.
- Death or disability: if you die before the end of the subscription, your estate is entitled to a refund of the unused portion. If you become disabled so that you cannot use the service (as confirmed by a physician), you may cancel and receive a refund of the unused portion.
- Relocation: where your state's law provides it, if you move your primary residence more than 50 miles from the area in which the service is offered to you and cannot use a comparable service, you may cancel and receive a refund of the unused portion.
- App store purchases: if you bought through Google Play or the Apple App Store, we will either issue the refund ourselves or request it from the store and assist you until it is completed.
15.7 Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". GIBSES OÜ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT YOU WILL FIND A MATCH, OR THAT OTHER USERS ARE WHO THEY CLAIM TO BE. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
15.8 Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GIBSES OÜ WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR TO THE CONDUCT OF OTHER USERS, ONLINE OR OFFLINE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) US $100. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR OUR GROSS NEGLIGENCE, WILLFUL MISCONDUCT OR FRAUD, OR FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE.
15.9 Indemnification
You agree to indemnify and hold harmless GiBSeS OÜ and its officers, employees and agents from any third-party claim, and the related reasonable costs including attorneys' fees, arising out of (a) the content you post or send, (b) your conduct towards other users, online or offline, or (c) your breach of these Terms or of the law. This does not apply to the extent the claim results from our own fault. We will notify you promptly of any such claim, and you may take part in its defense with counsel of your choice.
15.10 Changes to the Service and suspension of the free tier
We may change the Service and these Terms only as described in section 12. If a change materially reduces your rights, we will give you at least 30 days' notice by email and in the app, and you may close your account at no charge before it takes effect. We may suspend the free tier nationwide or in particular states for the reasons listed in section 12.3, with at least 60 days' notice: free accounts are deactivated, not closed, and are reactivated automatically if the free tier resumes or if you subscribe; you can export your data or delete your account at no charge; we will never charge you unless you expressly purchase a subscription with the disclosures and consent described in section 15.5; and existing paid subscriptions continue on their own terms.
