E-Raiden respects the intellectual property of others and asks its members to do the same. Members may upload only content they own or have permission to use. This policy explains how copyright owners can report infringing content under the US Digital Millennium Copyright Act (DMCA, 17 U.S.C. §512), and how members can respond.
1. How to send a notice of infringement
If you believe that content on E-Raiden infringes your copyright, send a written notice to our designated agent (see section 4). Under 17 U.S.C. §512(c)(3), the notice must include:
- a physical or electronic signature of the copyright owner or of a person authorized to act on their behalf;
- identification of the copyrighted work claimed to have been infringed (or, if several works are covered by one notice, a representative list);
- identification of the material claimed to be infringing and information reasonably sufficient for us to locate it (for example the profile link, or a description of the photo and the member's profile name);
- your contact information: name, postal address, telephone number and email address;
- a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act on behalf of the owner of the right allegedly infringed.
When we receive a complete notice, we promptly remove or disable access to the material and inform the member who posted it, with a copy of the notice (your personal contact details may be included, as the law expects them to be shared with the member who can file a counter-notice). Incomplete notices may not be acted upon.
Under 17 U.S.C. §512(f), anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. If you are unsure whether content infringes your rights, consider seeking legal advice before sending a notice.
2. Counter-notice
If your content was removed and you believe it was removed by mistake or misidentification, you can send a counter-notice to our designated agent. Under 17 U.S.C. §512(g)(3), it must include:
- your physical or electronic signature;
- identification of the material that was removed or disabled and the location where it appeared before removal;
- a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the US federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which GiBSeS OÜ may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We forward the counter-notice to the person who sent the original notice. Unless they inform us within 10 business days that they have filed a court action to restrain the alleged infringement, we restore the material between 10 and 14 business days after receiving the counter-notice.
3. Repeat infringers
We terminate, in appropriate circumstances, the accounts of members who are repeat infringers. As a rule, an account that receives three valid infringement notices that have not been successfully countered is closed; we may close an account sooner in case of clear or wilful infringement.
4. Designated agent
Send notices and counter-notices to our designated agent for copyright claims:
The registration of our designated agent with the US Copyright Office is in progress. The details below will be completed as soon as it is finalized; in the meantime you can send notices to the email address of the Terms of Service contact. office@e-raiden.vip
5. Other reports
This procedure covers only copyright. For other illegal content, including reports from the European Union under the Digital Services Act, use the reporting form. For intimate images shared without consent, use the intimate image removal page.
