Terms of Service

Welcome to E-Raiden. These Terms of Service ("Terms") govern the use of the E-Raiden platform, including the website, mobile applications and all related services (collectively, the "Service"). By reading and accepting these Terms, the user agrees to be bound by the provisions set out herein.

1. Acceptance of Terms

By accessing or using the Service, the user declares to have read, understood and fully accepted these Terms. If the Terms are not accepted, the Service may not be used.

Continued use of the Service after any changes to the Terms have been published constitutes acceptance of those changes. It is the user's responsibility to check the Terms periodically for updates.

2. Age Requirements

The Service is reserved exclusively for persons who are at least 18 years old. By registering, the user represents and warrants that they are at least 18. Age is self-declared at registration (and enforced by the platform); E-Raiden does not perform paid identity verification but reserves the right to suspend or delete accounts that appear to belong to minors.

In the event of a breach of this requirement, the account will be deleted immediately and without notice. Any associated data will be deleted in accordance with our Privacy Policy.

3. User Account

To use the features of the Service, you must create an account by providing truthful, accurate and complete information. The user is responsible for:

• Maintaining the confidentiality of their access credentials
• All activities that occur on their account
• Updating profile information promptly
• Notifying E-Raiden immediately in case of unauthorized access

E-Raiden reserves the right to suspend or delete accounts that violate these Terms, that are inactive for an extended period, or that are associated with fraudulent behaviour.

4. Premium Subscription

E-Raiden is free to use with every feature included and is supported by advertising. Users may optionally subscribe to Premium solely to remove advertising. Premium unlocks no additional feature — all features are available to every user.

Premium costs €7.99 per year and renews automatically for successive twelve-month periods until you cancel. Payments are processed by Stripe. You can cancel the renewal at any time from Settings › Privacy, Premium section, using “Cancel renewal”: cancelling gives no right to a refund, Premium stays active until the end of the period you have already paid for, and from then on your account returns to the free, ad-supported tier.

If you buy Premium as a consumer, you have the right to withdraw from the contract within 14 days of concluding it, without giving any reason and without penalty (Articles 9 to 16 of Directive 2011/83/EU). The period runs from the day Premium is activated, that is from your first purchase; automatic renewals continue the same contract and do not open a new period. You exercise withdrawal from Settings › Privacy, section “Right of withdrawal (14 days)”, using “Exercise the right of withdrawal”; while the period is open, that page shows you the date by which you can do so. You may also notify us of your withdrawal by sending an explicit statement to office@e-raiden.vip. Withdrawal closes Premium at once — advertising returns to your account — and we credit the refund using the same means of payment you used for the purchase, within 14 days of receiving your notice.

The amount of the refund depends on one circumstance only: whether, at the time of purchase, you expressly requested that Premium start immediately, without waiting for the 14 days to end. If you requested the immediate start — by ticking the dedicated box on the purchase screen, which is neither pre-ticked nor mandatory — we retain the share proportionate to the period you have already enjoyed, that is the annual price divided by 365 and multiplied by the whole days elapsed since activation, and we refund you all the rest (Article 14(3) of the Directive). If you did not request the immediate start, the refund is for the full amount: we charge you nothing for the days of use (Article 14(4)(b)). In no case does withdrawal entail any cost or penalty for you.

Withdrawal and cancellation are different things, and in the app they are two distinct commands. Withdrawal is available only within 14 days of purchase: it closes Premium at once and entitles you to the refund described above. Cancelling the renewal is available at any time, including after the 14 days: it gives no right to a refund, Premium stays active until the end of the period you have already paid for, and simply does not renew. In short: if you are within the 14 days and want your money back, you need withdrawal; if you only want to stop paying for the following year, you need cancellation.

We may change the Premium price with at least 30 days' notice before renewal; you may cancel before the change takes effect.

5. User Conduct

By using the Service, the user agrees NOT to:

• Create fake profiles or use the identity of others
• Harass, intimidate, threaten or defame other users
• Send unsolicited commercial messages (spam)
• Post illegal, offensive, obscene or discriminatory content
• Solicit money or financial information from other users
• Use the Service for illegal activities of any kind
• Attempt to access other users' accounts or data
• Use bots, scrapers or other automated tools
• Circumvent the security measures or restrictions of the Service

Violation of these rules entails the immediate suspension of the account and, in the most serious cases, referral to the competent authorities.

6. User Content

The user retains ownership of the content they post on the Service (photos, texts, messages). However, by posting content on E-Raiden, the user grants E-Raiden a non-exclusive, worldwide, royalty-free and transferable licence to use, reproduce, modify and display such content for the sole purpose of providing and improving the Service.

E-Raiden reserves the right to remove any content that violates these Terms or is deemed inappropriate, without prior notice. All content is subject to moderation.

It is forbidden to post:

• Sexually explicit or pornographic content
• Images depicting minors
• Violent, racist or hate-inciting content
• Personal information of third parties without their consent
• Copyright-protected material for which the user does not hold the rights

7. Intellectual Property

The Service and all of its original content (excluding user content), features, graphics, design and source code are and remain the exclusive property of E-Raiden and its licensors. The Service is protected by copyright, trademark and other intellectual property laws.

The "E-Raiden" trademark, the logo and all related marks are trademarks of GiBSeS OÜ. Use of these marks is not permitted without the prior written consent of the owner.

8. Limitation of Liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. E-Raiden does not warrant that the Service is error-free, secure or continuously available.

In no event shall E-Raiden be liable for:

• Direct, indirect, incidental or consequential damages arising from the use of the Service
• The conduct of other users, whether online or offline
• Loss of data, profits or opportunities
• Service interruptions caused by force majeure events

E-Raiden recommends that users take reasonable precautions when meeting people through the Service. See our safety page for useful tips.

9. Changes to the Terms

E-Raiden reserves the right to amend these Terms at any time. Changes will be communicated by publication on the Service and, for material changes, by email or in-app notification.

Continued use of the Service after the publication of the changes constitutes acceptance of the new Terms. If the user does not accept the changes, they must cease using the Service and request the deletion of their account.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Estonia, the registered seat of the controller GiBSeS OÜ. For any dispute arising out of or in connection with these Terms, the parties agree on the jurisdiction of the Courts of Tallinn (Estonia), without prejudice to the mandatory consumer-protection rules laid down by EU law and by the Member State of the user's residence.

Consumers residing in the European Union retain every right granted to them by EU consumer law. For an out-of-court settlement of a dispute you may turn to the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon) at the Estonian Consumer Protection and Technical Regulatory Authority (TTJA), or to the European Consumer Centre in your country, which assists free of charge with cross-border disputes within the EU. Your right to bring the matter before the competent court is unaffected.
